Elakar Adda - Terms and Conditions

Welcome to Elakar Adda! By downloading, installing, or using the Elakar Adda mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before using the App.

Elakar Adda is a neighborhood chat platform designed to connect community members across Bangladesh, fostering local communication and community engagement.

1. Acceptance of Terms

By creating an account or using Elakar Adda, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Eligibility

You must be at least 16 years old to use Elakar Adda. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration and Security

To use Elakar Adda, you must create an account with accurate and complete information, including your phone number for verification. You are responsible for:

Maintaining the confidentiality of your account credentials;
All activities that occur under your account;
Notifying us immediately of any unauthorized use of your account;
Ensuring your contact information remains current and accurate.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. License to Use the App

Subject to your compliance with these Terms, Elakar Adda grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes to communicate with members of your neighborhood community.

5. User Conduct and Community Guidelines

Elakar Adda is built to foster positive neighborhood connections. You agree to use the App responsibly and respectfully. You shall not:

Post, share, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;
Impersonate any person or entity, or falsely represent your affiliation with any person or entity;
Engage in spam, unsolicited advertising, or promotional activities without authorization;
Share false, misleading, or deceptive information that could harm your neighborhood community;
Harass, bully, or threaten other users;
Post content that violates the intellectual property rights, privacy rights, or other rights of any third party;
Use the App to conduct or promote any illegal activities;
Attempt to gain unauthorized access to other users' accounts or the App's systems;
Upload or transmit viruses, malware, or any other harmful code;
Interfere with or disrupt the App's functionality or servers;
Use automated systems (bots, scripts) to access the App without our permission;
Collect or harvest personal information of other users without consent;
Post content that incites violence, hatred, or discrimination based on race, ethnicity, religion, gender, or any other protected characteristic.

We reserve the right to remove any content that violates these guidelines and to suspend or terminate accounts of users who repeatedly violate these Terms.

6. Content Ownership and License

Your Content: You retain ownership of any content (messages, photos, videos, etc.) you post on Elakar Adda. However, by posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and transmit your content solely for the purpose of operating and providing the App's services.

Our Content: All rights, title, and interest in the App, including its design, features, trademarks, logos, and other intellectual property, are owned by Elakar Adda or its licensors. You may not copy, modify, distribute, sell, or reverse engineer any part of the App.

7. Neighborhood Verification

Elakar Adda uses location information to connect you with your local neighborhood community. By using the App, you consent to providing location information for neighborhood verification purposes. You may be required to verify your address or location to access certain neighborhood chat rooms.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

9. Prohibited Uses

You may not use Elakar Adda for any purpose that is illegal or prohibited by these Terms. Specifically, you shall not:

License, sell, rent, lease, transfer, assign, reproduce, distribute, host, or otherwise commercially exploit the App;
Modify, translate, or create derivative works based on the App;
Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App;
Remove, alter, or obscure any proprietary notices on the App;
Use the App in any way that could damage, disable, overburden, or impair our servers or networks.

10. Termination

We reserve the right to suspend or terminate your access to Elakar Adda at any time, with or without notice, for any reason, including:

Violation of these Terms or our Community Guidelines;
Engaging in fraudulent or illegal activities;
Creating multiple accounts or attempting to circumvent account restrictions;
Upon your request to delete your account.

Upon termination, you must immediately cease using the App and delete all copies from your devices. Sections of these Terms that by their nature should survive termination will remain in effect.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

The App will be uninterrupted, secure, or error-free;
The quality of the App will meet your expectations;
Any errors or defects will be corrected;
The App will be compatible with all devices or operating systems.

Your use of the App is at your sole risk. We are not responsible for the content posted by users or any interactions between users.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELAKAR ADDA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, data, or goodwill;
Service interruptions;
Damages resulting from your use or inability to use the App;
Unauthorized access to your account or data;
Statements or conduct of any third party on the App;
Any other matter relating to the App.

In any case, our total liability to you shall not exceed the amount you paid to use the App (if any) in the twelve (12) months prior to the event giving rise to the liability.

13. Indemnification

You agree to indemnify, defend, and hold harmless Elakar Adda and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the App;
Your violation of these Terms;
Your violation of any rights of another party;
Any content you post on the App.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to conflict of law principles. Any disputes arising under or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Dhaka, Bangladesh, and you hereby consent to the jurisdiction of such courts.

15. Dispute Resolution

If you have any concerns or disputes, we encourage you to first contact us at support@elakaradda.com to seek an informal resolution. We are committed to working with you to resolve any issues amicably.

16. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice. We may also update these Terms from time to time. Material changes will be notified through the App or via email. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

It is your responsibility to review these Terms periodically for any updates.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Elakar Adda regarding your use of the App and supersede any prior agreements.
